Terms and conditions governing use of the Twinroom website

These terms and conditions set out the rights and obligations of all users (either as individuals or as a group) and those of Twinroom in relation to the services offered by Twinroom by way of this website. Before you click on the "confirm" button at the end of the booking process, please carefully read these terms and conditions. By clicking on the "confirm" button you are consenting to be bound by these terms and conditions. If you do not agree to all of the terms and conditions, do not click on the "confirm" button. Parties

These terms and conditions are made between Twinroom Limited ("Twinroom") and whosoever shall use this website ("You").

Use of Site

You may only use the website to make legitimate enquiries or bookings and hereby undertakes not to make any speculative, false or fraudulent booking or any booking in anticipation of demand. You also undertake to provide correct and accurate e-mail, postal and/or other contact details to Twinroom and acknowledge that Twinroom may use these details to contact you in the event that this should prove necessary.

Making a Booking

Any booking made or order placed by you shall be deemed to be an offer by you to purchase the relevant hotel accommodation subject to these booking conditions. No contract between you and Twinroom shall come into existence until Twinroom (a) issues a booking reference number; (b) issues a booking confirmation by email or fax; and (c) receives payment in full.

Amendments and cancellations by you

Amendments and changes where EITHER the number of rooms OR the number of nights decreases will be charged as below. No charges will be made for any amendments or cancellations made within 24 hours of booking unless your reservation is within 72 hours of arrival. Rooms cancelled within 72 hours of arrival will be charged at the first night's accommodation rate. All other cancellations and amendments are subject to a $15 fee (£11 or €16 where reservations have been made in GBP or Euros respectively).
No-shows (where guests do not arrive at the hotel for whatever reason) are charged at the full cost of the booking. On occasions, particularly during fair periods it may be necessary to vary these terms in accordance with terms laid down by our suppliers. Twinroom reserves the right to alter this charging structure in such circumstances by notifying you in advance and gaining your acceptance.

If you do not arrive at the accommodation on the date on which you booked to arrive or you leave the accommodation earlier than the date on which you booked to leave, then you will only be entitled to cancel or amend the booking from the time when Twinroom receives notification from you during Twinroom working hours. All such cancellations and amendments are subject to you incurring the charge for the next twenty-four hours accommodation after Twinroom's receipt of notification.

Cancellations and/or amendments of bookings will only be valid if effected through the web site or to Twinroom in writing and reconfirmed to a customer in writing by Twinroom.

Amendments, cancellations and curtailment by the hotel

In the very unlikely event that the hotelier cannot provide the booked accommodation, you understand that the hotelier's responsibility is to find an alternative of at least a similar standard, and provide transportation as appropriate to this alternative hotel. Twinroom takes every precaution to ensure hotels are professionally managed so that any such occurrence is extremely rare. Twinroom shall have no liability in respect of any other costs, losses or damages existing out of or in connection with relocation of accommodation since such relocation is outside Twinroom's control.

Payment for reservations is due, in all cases, before the customer travels. Regardless of whether vouchers have been issued or not, Twinroom reserves the right to cancel reservations if payment has not been received, or if payment is still outstanding for any other unrelated reservations.

Accuracy of Information

Twinroom and its suppliers have taken reasonable care to ensure that the content of the website including all hotel information, city information and listings are accurate. The hotel information and listings are compiled from information provided by the hotels that are listed. Twinroom publishes such information in good faith. You acknowledge and accept that Twinroom cannot be held responsible for any inaccuracies in such information, nor can liability be accepted for changes to facilities which are not notified to Twinroom by the hotel in question. You also acknowledge that while Twinroom endeavours to keep accurate and up-to-date all information contained on this website, Twinroom cannot be responsible for errors, omissions or misleading information contained in the hotel listings or information.

Star Ratings and quality of Accommodation

You acknowledge that star ratings may vary in quality from country to country and cannot be relied on to identify the quality of the accommodation. You acknowledge that the star rating is merely a general outline and may not apply in each case. Similarly, you acknowledge that the type of rooms provided by a hotel (i.e. single, double, twin, triple) may also vary from country to country. It is your responsibility to check the type of the accommodation and services provided by each hotel. Details of each hotel which may be booked via this website are outlined in this website.

Discounted rates

Hotels sometimes impose supplements which means that the price advertised on Twinroom may be higher than the hotel's published rate. This can happen at any period when rooms are very scarce. Twinroom will only sell a room at higher than the published rate if it feels that its customer's interest is better served by having this room rather than finding nothing available at all. In such busy periods, and only at the customer's request, Twinroom sometimes finds rooms in hotels which have been reliably recommended by third parties. Such hotels are offered to clients in good faith.
Complaints

Any complaint regarding the Hotel should be notified to the Hotel Reception desk or to the relevant Hotel Representative during your stay at the hotel and the hotel management must be given adequate opportunity to rectify the situation from the outset. Where any such complaint is not rectified by the hotel in question to your satisfaction, you should contact Twinroom immediately and Twinroom will endeavour to assist. Should you remain unsatisfied a further complaint should be made in writing to Twinroom not later than seven days after termination of the hotel stay. Where possible, the written complaint to Twinroom should be supported by photographs or other written/visible proof of the complaint.

Passports and Visas

Twinroom cannot be held liable for any loss incurred in the event of your failure to hold the necessary passports, visas and documentation for their journey. You are advised to check with the relevant visa departments of the Countries they wish to visit.
Price changes

Twinroom reserves the right to revise all published prices at any time and for any reason, however no change in price will be made once a booking has been confirmed.

Room types

i) Twin/Double rooms: Hotels often have much fewer double rooms than twins and the provision of a double room by the hotel (even if requested as a preference) is not guaranteed, unless its importance is specifically mentioned to Twinroom at the time of reservation and Twinroom then confirms with the mention 'double' room

ii) Triple and Quadruple rooms: Some triple rooms consist of three single beds while others consist of one double and one single. In the same way quadruple rooms can consist of four singles, or two double beds, or one double and two singles.

Twinroom cannot accept responsibility for any specific needs not made known at the time of booking.
Accommodation costs

On receipt of your voucher Twinroom accepts responsibility for paying your accommodation costs and therefore cannot accept any responsibility for clients who pay directly to the hotel.

Indemnity

You agree to indemnify and hold harmless Twinroom from and against any liability, damage or loss including legal fees and expenses that Twinroom incurs or suffers as a result of any action, inaction or omission by you.

Consequential Loss

Under no conditions and in no event shall Twinroom or its suppliers be liable for any consequential or special damages or losses, however arising, (including, but not limited to negligence or breach of these terms and conditions or otherwise) or for any loss of data, profit, revenue or business, howsoever caused even if that loss or damage was foreseeable by, or the possibility of it was brought to the attention of Twinroom.

Limitation of Liability

Notwithstanding the foregoing, Twinroom's liability to you and/or any third parties are in any and all circumstances limited to the lesser of either:-

(a) the amount paid by you of the booking; or

(b) £500.

Assignment

You may not assign, convey, sub-contract or delegate any rights, duties or obligations hereunder except with the written consent of Twinroom.
Intellectual Property

You acknowledges that all copyright, trademarks and other intellectual property rights in and relating to this website are solely owned by or licensed to Twinroom. The content or data found on the website may not be reproduced, sold, transferred or modified without the prior written consent of Twinroom. Neither may you modify, duplicate, display, copy, reproduce, licence, publish, transfer or sell any information, software, products or services obtained from the website without the prior written consent of Twinroom. You further acknowledge that you must not use any of these intellectual property rights, except to the extent necessary to make a booking in the manner anticipated by these terms and conditions.
System Integrity

The usage of any device, routine or software which inhibits or interferes with the running of the Twinroom website or any booking concluded upon it is prohibited. Any action which creates a load on the Twinroom website or infrastructure which may be considered unreasonable or disproportionate is prohibited.

No Guarantee of Continuous Access to Twinroom Website

Twinroom does guarantee continuous access without interruption to its website, nor does Twinroom guarantee secure access to its services. The performance of the Twinroom website may be interfered with by many factors outside its control.

Amendment to These Terms and Conditions

Twinroom reserves the right to amend these Terms and Conditions at any time. Updates will be effective 5 days after they are posted on the Twinroom website. This Agreement cannot otherwise be altered without prior consultation with Twinroom.

Severability

These terms shall be deemed severable. In the event that any provision is determined to be unenforceable or invalid, such provision shall nonetheless be enforced to the fullest extent permitted by applicable law and such determination shall not effect the validity and enforceability of any other remaining provisions.

Headings

The headings used in these Terms and Conditions are included for convenience only and shall not define, extend, limit or otherwise affect these Terms and Conditions.

Force Majeure

If as a consequence of Force Majeure, Twinroom is obliged to curtail, alter or cancel a booking, you shall not be entitled to claim compensation for any loss arising as a consequence of the said curtailment, alteration or cancellation. The term "Force Majeure" includes but is not limited to acts of God, natural disaster, fire and any other destruction of any accommodation booked, riots, acts of war or civil commotion, exercise of legislative, municipal, military or other authority, strikes, industrial action or any other reason beyond the control of Twinroom.

Entire Agreement

These terms contain the entire agreement between Twinroom and you and supersedes any prior understandings or agreements (whether oral or written) regarding the subject matter and may not be amended or modified unless expressly agreed by Twinroom in writing.

Governing Law

These Terms and Conditions are subject to English Law and to the exclusive jurisdiction of the Courts of England.
